The Reinken Law Firm recently won a $20,000,000 jury verdict against the estate of a defendant who committed child sexual abuse in Stamford-Norwalk Judicial District, Superior Court. The plaintiff, in that case, testified that her father sexually abused and exploited her for eleven years starting when she was six years old. The abuse allegedly continued and progressed through 1986, when plaintiff was 17. Her father, defendant’s decedent, died in 2014. Michael Dowd of New York was plaintiff’s co-counsel on the case. This verdict was reported to be the largest verdict in a personal injury case in the Judicial District. Furthermore, at the time, it was the largest award in a sexual abuse case in the state.
The plaintiff testified she suffered from extreme emotional trauma, mental anguish, and depression with suicidal thoughts, eating disorders, and post-traumatic stress syndrome as a result of the defendant’s abuse. Plaintiff claimed she was unable to pursue the normal enjoyment of life and had trouble with her marital sexual relationship because of the past abuse. She sought damages for past, present and future pain and suffering.
The plaintiff provided testimony from her three brothers, who stated decedent admitted to them his sexual abuse of their sister, and/or they witnessed an assault. The defendant’s attorneys contended plaintiff had no medical proof of a causal relationship between the alleged abuse and her psychological injuries, or that she suffered psychological injury as a result of her alleged abuse. Further, that the abuse never happened, that her testimony was confusing, contradictory, unreliable and inconsistent with sworn statements she had previously made, and that her claims were barred by a 30-year statute of limitations.
The jury was unpersuaded by the defendant’s many claims. Following one and a half days of deliberations, the jury awarded $5,000,000 for mental anguish, $5,000,000 for psychological trauma, $3,000,000 for permanency of the injuries, and $2,000,000 for inability to pursue enjoyment of life and authorized an award punitive damages which were expected to be $5,000,000.
